These Terms and Conditions of Use (hereinafter, the "Terms") constitute a binding legal agreement between you (the "User") and 3LOX LLC (hereinafter, "3LOX", "we", "us", or "our"), a company validly incorporated under the laws of the State of Florida, United States, with a registered office at 7791 NW 46th Street, Suite 219, Doral, FL 33166, and govern the access to and use of the 360° PathFinder platform (hereinafter, the "Service").

By accessing, registering for, or using the Service in any way, you declare that you have read, understood, and fully accepted these Terms, as well as our Privacy Policy and our Cookie Policy.

If you access or use the Service on behalf of an educational institution, company, organization, or any legal entity (hereinafter, the "Institution"), you represent and warrant that you have sufficient legal authority to bind such Institution to these Terms.

If you do not agree to any of these Terms, you must not access or use the Service.

1. Definitions

For the purposes of these Terms, the following concepts shall have the meaning indicated below:

  • Account: Individual or institutional registration created to access the Service, which includes authentication credentials and a user profile.
  • User Content: All information, data, responses to assessments, files, text, or material that the User or their representatives upload, input, or generate within the Service.
  • Assessments: Psychometric, vocational, personality, interest, skills, values, and preference instruments available in the Service, including models such as HEXACO, DISC, Enneagram, RIASEC, Strong, Gardner, Schwartz, IKIGAI, and Value Creation Roles (RCV), among others.
  • Reports: The reports, analyses, profiles, and recommendations generated by the Service based on the responses provided by the User in the Assessments.
  • Explorer: Internal designation for any user who goes through the assessment and vocational self-discovery process within the platform.
  • Facilitator: Vocational counselor, educational psychologist, career coach, or other professional who accompanies the Explorer in the interpretation of results.
  • Referent: Parent, guardian, teacher, or another person from the Explorer's environment who participates as an external validator in the process.
  • Institution: School, university, company, non-governmental organization, or any legal entity that contracts the Service for its members, students, or collaborators.
  • Privacy Policy: Supplementary document describing the processing of personal data, available at https://360pathfinder.com/politica-privacidad.
  • Cookie Policy: Document describing the use of cookies and similar technologies, available at https://360pathfinder.com/politica-cookies.

2. Description of the Service

2.1 Nature of the Service

360° PathFinder is a technological platform for vocational guidance and professional purpose development, designed and operated by 3LOX LLC.

The platform integrates assessments based on internationally recognized scientific models—such as HEXACO, DISC, Enneagram, RIASEC, Strong Interest Inventory, Gardner's Multiple Intelligences, Schwartz's Values, IKIGAI, and the proprietary Value Creation Roles (RCV) framework—, artificial intelligence assistants, and complementary modules such as the Possible Trajectories Map (MTP), Action Plan, Smart CV Builder, Scholarship Portal, Vocational Resource Center, and Facilitator Marketplace.

2.2 Target Audience

The Service is designed to accompany individuals at different stages of their professional lives. User profiles include, but are not limited to:

  • Explorers: High school students (from 14 years old) facing the choice of a professional path for the first time and seeking to discover their passions, talents, and interests.
  • Validators: University students or recent graduates (typically between 19 and 24 years old) who need to confirm, adjust, or redirect their academic or professional choices.
  • Renovators: Experienced professionals (typically between 28 and 45 years old) seeking to reinvent themselves, change careers, or reconnect with their professional purpose.
  • Transcendents: Senior professionals, leaders, and experts (typically over 45 years old) who wish to design their legacy, mentor, or contribute to impact projects.
  • Educational Institutions: Schools, institutes, and universities implementing the Service as part of their vocational guidance programs.
  • Companies and Organizations: Entities using the Service for talent development programs, career transitions (outplacement), or employee wellness.
  • Families: Fathers, mothers, and guardians participating as Referents in the process of their children or dependents, accessing specific tracking portals.
  • Professional Facilitators: Vocational counselors, psychologists, coaches, and mentors using the platform as a support tool in their professional practice.

2.3 Guiding Nature of the Service and Recommendation for Professional Accompaniment

IMPORTANT NOTICE: The Service is strictly of a guiding and informational nature.

The Reports, recommendations, career suggestions, and professional trajectories generated by the platform are the result of the algorithmic processing of the responses provided by the User in the Assessments, and in no case constitute:

  • Medical, psychological, or psychiatric diagnoses.
  • Binding professional advice on educational, employment, financial, or legal matters.
  • Clinical evaluations of aptitudes, cognitive abilities, or mental health conditions.
  • Automated decisions with legal effects on the User, under the terms of Article 22 of the GDPR.
  • Guarantees of academic, professional, economic, or personal success.

360° PathFinder explicitly recommends that the results of the Assessments and Reports be interpreted and complemented with the accompaniment of a qualified professional (vocational counselor, psychologist, career coach, or certified facilitator) who can contextualize the findings according to the User's personal, academic, family, and socioeconomic circumstances.

The quality, accuracy, and usefulness of the Reports depend directly on the truthfulness, completeness, and seriousness with which the User responds to the Assessments. 3LOX is not responsible for results derived from incomplete, random, or intentionally erroneous responses.

3. Eligibility and User Accounts

3.1 Minimum Age

To create an Account and use the Service, the User must be at least 14 years old.

This minimum age is established in compliance with:

  • Spain: Article 7 of Organic Law 3/2018 on Personal Data Protection and Guarantee of Digital Rights (LOPDGDD), which sets 14 years as the minimum age for digital consent.
  • European Union: Article 8 of the GDPR, which allows Member States to establish a minimum age for digital consent between 13 and 16 years. In countries where the legal minimum age is over 14 years (such as Germany, the Netherlands, or France with 16 years), additional verifiable parental consent will be required.
  • United States: For children under 13, verifiable parental consent is required pursuant to COPPA (Children's Online Privacy Protection Act). Users between 13 and 17 can access with parental or institutional consent.
  • Colombia: Law 1581 of 2012 and Decree 1377 of 2013 establish that the data of minors require authorization from the legal representative. The consent of individuals over 14 is considered valid when mediated by educational institutional authorization.
  • Latin America (other countries): Local child protection and digital consent laws of each jurisdiction will apply.

In all cases, use by individuals under 18 will require authorization from a parent, guardian, or Educational Institution.

3.2 Consent for Minors

Consent requirements for minors vary depending on the User's jurisdiction:

  • In Spain: Users aged 14 to 17 can accept these Terms and consent for themselves under Art. 7 of the LOPDGDD. Minors under 14 require authorization from their parents or legal guardians.
  • In other EU countries: Users who exceed the minimum digital consent age of their country (between 13 and 16 years) can consent for themselves. Below that age, parental authorization is required.
  • In the USA, Colombia, and Latin America: Minors under 18 must have authorization from their parents, legal guardians, or Educational Institution.

In all cases, Educational Institutions contracting the Service for their students are responsible for obtaining and documenting the necessary consents in accordance with applicable legislation in their jurisdiction.

3.3 Account Responsibility

The User is responsible for maintaining the confidentiality of their login credentials and for all activities carried out from their Account. In the event of unauthorized use, they must immediately notify legal@3lox.com.

When the User is a minor, their parents or guardians share the responsibility of supervising the use of the platform and the activities carried out on it.

3.4 Accuracy of Information

The User guarantees that all information provided when creating their Account and when responding to the Assessments is true, complete, and up-to-date. 3LOX reserves the right to suspend or cancel Accounts containing false or fraudulent information.

4. Plans, Pricing, and Contracting

4.1 Available Plans

3LOX offers various subscription plans with different levels of functionality and access. Current plans, features, pricing, and specific conditions are detailed and updated on the official Service page: https://360pathfinder.com/precios.

3LOX reserves the right to modify, add, or discontinue plans at any time. Changes in plans will not affect active subscriptions until the end of their contracted period, unless otherwise agreed between the parties.

4.2 Institutional Contracting

Institutions may contract the Service through corporate or educational licenses. The details of pricing, volumes, discounts, and specific conditions will be governed by the purchase order, commercial proposal, or contract individually signed between the Institution and 3LOX LLC.

The commercial conditions agreed upon in writing between 3LOX and an Institution shall prevail over any general provision of these Terms in case of conflict.

4.3 Pilot Tests and Free Plans

3LOX may offer, at its sole discretion, pilot tests, limited access, or free plans with restricted functionalities. These offers may be modified or withdrawn without prior notice and do not generate a contractual obligation of permanence.

5. Payments, Billing, and Cancellation

Payments are securely processed through certified payment platforms (PCI DSS), such as Stripe or equivalents.

Published prices will include or exclude taxes as indicated in each case and in accordance with the applicable tax legislation in the User's jurisdiction.

Fees are non-refundable once the service period has started, except as provided by consumer legislation applicable to the User (including the 14-calendar-day right of withdrawal for European Union consumers under Directive 2011/83/EU, where applicable and the service has not been fully executed).

Cancellation prevents future charges but does not grant retroactive refunds for periods already initiated.

In the event of payment default, 3LOX may suspend access to the Service with prior notice to the User or the Institution.

6. Acceptable Use

The User agrees to use the Service lawfully, ethically, and in accordance with its purpose. In particular, the User agrees not to:

  • Bypass, disable, or interfere with the security features of the Service.
  • Reverse engineer, decompile, disassemble, or attempt to extract the source code, algorithms, or architecture of the Service.
  • Access the Service via bots, scrapers, automated scripts, or other unauthorized means.
  • Upload, transmit, or distribute illegal, defamatory, obscene, threatening, or harmful content.
  • Impersonate another person or entity, or provide false information.
  • Use the Service to harass, discriminate, intimidate, or harm third parties.
  • Share, distribute, sublicense, or commercialize the generated Reports without prior written authorization from 3LOX.
  • Use the results or Reports for purposes other than vocational guidance and personal development.
  • Use the results as the sole criterion for making academic, employment, admission, or personnel selection decisions without the intervention of a qualified professional.

7. Intellectual Property

7.1 3LOX Rights

3LOX LLC and its licensors retain all intellectual and industrial property rights over the Service, including, without limitation: the software, source code, interfaces, graphic designs, trademarks (including "360° PathFinder", "360PathFinder" and its logos), trade names, algorithms, data models, methodologies, proprietary theoretical frameworks, Reports, editorial content, and any related material.

7.2 User License

The Reports generated by the Service are the intellectual property of 3LOX LLC. The User receives a personal, limited, non-exclusive, non-transferable, and revocable license to access and use said Reports exclusively for vocational guidance and personal development purposes.

This license does not authorize the User to reproduce, modify, distribute, sublicense, sell, or commercially exploit the Reports, in whole or in part, without prior written authorization from 3LOX.

8. User Content and Limited License

The User retains all ownership rights over their Content (responses to assessments, personal data, uploaded files).

By using the Service, the User grants 3LOX LLC a non-exclusive, worldwide, royalty-free, and time-limited license (during the validity of the Account) to host, process, analyze, and display such Content for the sole purpose of operating, providing, and improving the Service.

3LOX may use anonymized and aggregated data (which do not allow for the direct or indirect identification of the User) for research, statistical analysis, and Service improvement purposes, without time limits.

9. Personal Data Processing and Privacy

The processing of personal data is governed by the 360° PathFinder Privacy Policy, available at https://360pathfinder.com/politica-privacidad, which is an integral part of these Terms.

3LOX LLC complies with the following data protection regulations:

  • European Union: General Data Protection Regulation (GDPR - Regulation EU 2016/679) and Organic Law 3/2018 (LOPDGDD) of Spain.
  • United States: COPPA (Children's Online Privacy Protection Act), CCPA/CPRA (California Consumer Privacy Act / California Privacy Rights Act), and applicable state laws.
  • Colombia: Law 1581 of 2012 (Personal Data Protection Law) and Decree 1377 of 2013.
  • Latin America: Habeas Data laws and national data protection regulations of each jurisdiction (including, among others, the LGPD of Brazil, Law 19.628 of Chile, and the LFPDPPP of Mexico).

Data may be hosted on Amazon Web Services (AWS) servers located in the United States, Germany, or other countries, in accordance with the Standard Contractual Clauses (SCCs) approved by the European Commission and applicable additional security safeguards.

10. Use of Artificial Intelligence and Proprietary Algorithms

10.1 Proprietary Technology

360° PathFinder utilizes artificial intelligence algorithms and data processing models designed, developed, and maintained entirely by the 3LOX LLC technical team as the exclusive intellectual property of the company.

These algorithms include, without limitation:

  • The IKIGAI synthesis algorithm, which integrates the results of 14 psychometric instruments to determine the User's intersection of purpose.
  • The Value Creation Roles (RCV) model, a proprietary framework that translates psychometric profiles into strategic professional value creation roles (Maker, Marketer, Manager, Mentor).
  • The Possible Trajectories Map (MTP) generation engine, which produces personalized future projections.
  • The personalized AI assistant (K-AI), which learns from the User's psychometric profile to offer contextualized guidance.
  • The Action Plan generation and career recommendation algorithms.

10.2 Guiding Nature of the Results

The results generated by the 360° PathFinder algorithms and artificial intelligence have purely guiding and informational purposes.

The User acknowledges and accepts that:

  • The Reports and recommendations do not constitute automated decisions with legal effects under the terms of Article 22 of the GDPR or the European AI Act (Regulation EU 2024/1689).
  • The results are conditioned and depend directly on the quality, truthfulness, and completeness of the responses provided by the User.
  • No result of the Service constitutes a professional, medical, or psychological diagnosis, nor a guarantee of employability or academic success.
  • It is expressly recommended that the User complement the results of the Service with the assistance of a qualified professional (vocational counselor, psychologist, coach) for a comprehensive and personalized interpretation of the findings.
  • The User retains at all times the final and exclusive responsibility for their academic, professional, and life decisions.

10.3 Algorithmic Transparency

3LOX is committed to maintaining an adequate level of transparency regarding the general operation of its algorithms, without prejudice to the protection of its trade secrets and intellectual property. The User may request information on the general logic of the algorithms that affect them in accordance with Article 22.3 of the GDPR and applicable regulations.

11. Protection of Minors

When the Service is used by minors (according to the legislation of each jurisdiction), the following protective measures will apply:

  • In Spain, users aged 14 to 17 can consent for themselves. In other jurisdictions, the Institution or parents/guardians must provide prior and verifiable informed consent.
  • 360° PathFinder will automatically disable all marketing and tracking cookies for underage users.
  • Only the data strictly necessary for the provision of the Service for educational purposes will be collected (data minimization principle).
  • Minors' data will be retained for a maximum of 24 months from the last activity, after which it will be deleted or anonymized.
  • Parents, guardians, or institutional representatives may request access, rectification, or deletion of minors' data at any time by writing to legal@3lox.com.
  • 3LOX will not request information from minors outside the educational and vocational context.
  • The Service will not include personalized advertising directed at minors.

12. Educational Regulatory Compliance

12.1 FERPA (United States)

When the Service is used by educational institutions in the United States, 3LOX LLC will act as a "School Official" with a "legitimate educational interest" in accordance with the Family Educational Rights and Privacy Act (FERPA), using the data exclusively for educational and vocational guidance purposes.

12.2 European Educational Regulations

In the European Union, data processing in the educational environment is carried out in accordance with the GDPR and applicable national laws. In Spain, processing is legitimized by the teaching and guiding function contemplated in the Organic Law on Education (LOE/LOMLOE).

12.3 Colombian and Latin American Educational Regulations

In Colombia, the processing of educational data is governed by Law 1581 of 2012 and the regulations of the Ministry of National Education. In other Latin American countries, local educational data protection laws will apply.

13. Service Limitations and Disclaimer of Liability

13.1 Nature of the Service

The User expressly acknowledges and accepts that:

  • The 360° PathFinder Assessments and Reports are for educational and guiding purposes only.
  • They do not constitute, replace, or equate to medical, psychological, or psychiatric diagnoses or clinical evaluations of any kind.
  • The results are a statistical approximation based on the User's responses and recognized scientific models, but they are not infallible or exhaustive.
  • 3LOX expressly recommends that results be complemented with professional accompaniment (vocational counselors, educational psychologists, career coaches, or other qualified professionals) for proper and personalized interpretation.
  • 3LOX does not guarantee academic, employment, economic, university admission, or personal results derived from the use of the Service. No information provided by the Service should be construed as a promise, guarantee, or prediction of future success.

13.2 Disclaimer of Liability

To the maximum extent permitted by applicable law, 3LOX LLC shall not be liable for:

  • Any academic, professional, financial, or personal decision the User makes based on the Reports or results of the Service.
  • Direct, indirect, incidental, special, consequential, punitive, or exemplary damages arising out of the use or inability to use the Service.
  • Inaccuracies, errors, or omissions in the generated Reports, which depend on the responses provided by the User.
  • Losses arising from interruptions, technical failures, cyberattacks, third-party actions, or events beyond its reasonable control.
  • The content, practices, or privacy policies of third-party websites, platforms, or services linked from the Service.

This disclaimer shall not exclude or limit 3LOX's liability where applicable law does not allow such exclusion or limitation (including, without limitation, the non-waivable rights of consumers under Spanish, European, or applicable law).

13.3 Limitation of Liability

Notwithstanding the foregoing, the total cumulative liability of 3LOX LLC to the User or the Institution for any claim arising out of the use of the Service shall not exceed, in any case, the greater of the following amounts: (a) the amount actually paid by the User or the Institution to 3LOX in the 12 months immediately preceding the event giving rise to the claim, or (b) one hundred US dollars (USD 100.00).

14. Third-Party Services and Integrations

The Service may include integrations, connections, tools, or links to services provided by third parties, including, but not limited to:

  • Payment platforms (Stripe and equivalents).
  • Analytics and performance services (Google Analytics, Hotjar).
  • Marketing and CRM tools (Meta Pixel, Google Ads, Clientify).
  • Cloud infrastructure (Amazon Web Services).
  • Third-party artificial intelligence services.
  • Communication and notification platforms.
  • Identity verification and authentication services.
  • Any other tool or service that 3LOX integrates in the future to improve the delivery of the Service.

3LOX does not control, endorse, or assume responsibility for the content, operation, availability, privacy policies, or security practices of these providers. The use of third-party services is subject to the terms and conditions of each provider.

15. Service Modifications

3LOX LLC may update, modify, add, or suspend features of the Service at any time to improve the User experience, comply with legal requirements, or for technical or operational reasons.

When such modifications materially affect an Institution during an active contract, 3LOX will notify in advance with at least 30 days' notice, unless the modification is required by law or for security reasons.

16. Indemnification

The User agrees to indemnify, defend, and hold harmless 3LOX LLC, its officers, employees, agents, affiliates, and licensors from and against any claim, demand, damages, loss, costs, or expenses (including reasonable attorneys' fees) arising out of:

  • The User's misuse of the Service.
  • Violation of these Terms or any applicable law.
  • Infringement of third-party rights.
  • User Content uploaded or transmitted through the Service.

17. Regulatory Compliance and International Use

The User agrees to comply with all laws, regulations, and rules applicable in their jurisdiction, including, without limitation, those related to data protection, intellectual property, child protection, e-commerce, and export controls.

The Service is available for use in jurisdictions where its operation is legal. The User may not access or use the Service in jurisdictions where its offer or use is contrary to the law.

3LOX is committed to adapting its practices in accordance with regulatory developments regarding artificial intelligence, including the European AI Act (Regulation EU 2024/1689) and equivalent regulations in other jurisdictions.

18. Force Majeure

3LOX LLC shall not be liable for delays, interruptions, or failures in the provision of the Service due to causes beyond its reasonable control, including, without limitation: natural disasters, pandemics, acts of terrorism, cyberattacks, third-party infrastructure failures, Internet outages, governmental actions, strikes, or any other force majeure event.

19. Suspension or Termination of Service

3LOX LLC may temporarily suspend or permanently terminate the User's access if:

  • The User breaches these Terms or any supplementary policy.
  • Fraudulent or abusive activity is detected, or activity that puts the security of the platform or other users at risk.
  • Required by a court or administrative order.
  • The User fails to pay agreed fees within the established deadlines.

Upon termination, the User's personal data will be deleted or anonymized within a maximum period of 30 days, unless applicable law requires a different retention period.

The sections relating to Intellectual Property (7), Limitation of Liability (13), Indemnification (16), and Applicable Law (20) shall survive termination.

20. Dispute Resolution and Applicable Law

20.1 Amicable Resolution

The parties will endeavor to resolve any dispute amicably and in good faith. If an agreement is not reached within 30 days, the parties may resort to mediation.

20.2 Jurisdiction according to User's territory

  • European Union Users: may turn to the data protection authority or competent courts of their country of residence, in accordance with the rights conferred by the GDPR and applicable consumer legislation. Spanish consumers may turn to the AEPD or the Courts and Tribunals of their domicile. They may also use the European Online Dispute Resolution (ODR) Platform: https://ec.europa.eu/consumers/odr.
  • Colombian Users: may turn to the Superintendency of Industry and Commerce (SIC) or the competent courts in accordance with Colombian legislation.
  • Users from other Latin American countries: consumer protection rules and dispute resolution mechanisms of their jurisdiction will apply.
  • Users in the United States and other countries: any dispute will be governed by the laws of the State of Florida, United States, and will be resolved before the federal or state courts located in Miami-Dade County, Florida.

20.3 Class Action Waiver

To the extent permitted by applicable law, the User agrees that any claim or dispute will be resolved on an individual basis and waives the right to participate in class actions against 3LOX LLC.

21. Changes to the Terms

3LOX LLC may update these Terms at any time. Modifications will take effect upon posting on the official website of the Service (https://360pathfinder.com/terminos-condiciones). For material changes, 3LOX will notify the User by email or through a prominent notice within the platform at least 15 days in advance.

Continued use of the Service after the effective date of the changes constitutes acceptance of the modified Terms. If the User does not agree with the changes, they must stop using the Service and request the deletion of their Account.

22. General Provisions

  • Entire Agreement: These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between the User and 3LOX regarding the Service, and supersede any prior agreements or communications.
  • Severability: If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.
  • Waiver: The failure to exercise or delay in exercising any right by 3LOX shall not constitute a waiver of that right.
  • Assignment: The User may not assign or transfer their rights or obligations under these Terms without prior written consent from 3LOX. 3LOX may assign its rights and obligations to any successor or purchaser.
  • Language: In case of discrepancy between translated versions of these Terms, the Spanish version published on the official website shall prevail.
