2. Description of the Service

2.1 Nature of the Service

360° PathFinder is a technology platform for vocational guidance and professional purpose development, designed, developed, and operated by 3LOX LLC.

The platform integrates assessments based on internationally recognized scientific models — such as HEXACO, DISC, Enneagram, RIASEC, Strong Interest Inventory, Gardner's Multiple Intelligences, Schwartz Values, IKIGAI, and the proprietary Value Creation Roles (VCR) framework — along with artificial intelligence assistants and complementary modules such as the Possible Career Trajectory Map (MTP), Action Plan, Intelligent CV Builder, Scholarship Portal, Vocational Resource Center, and Facilitator Marketplace.

2.2 Target Audience

The Service is designed to accompany individuals at different stages of their professional journey. User profiles include, without limitation:

  • Explorers: high school and secondary school students (from age 14) facing their first professional path decision who seek to discover their passions, talents, and interests.
  • Validators: university students or recent graduates (generally between 19 and 24) who need to confirm, adjust, or redirect their academic or professional choice.
  • Renewers: experienced professionals (generally between 28 and 45) seeking reinvention, career change, or reconnection with their professional purpose.
  • Transcenders: senior professionals, leaders, and experts (generally over 45) wishing to design their legacy, mentor others, or contribute to impact projects.
  • Educational institutions: schools, institutes, and universities that implement the Service as part of their vocational guidance programs.
  • Companies and organizations: entities using the Service for talent development, outplacement, or employee wellbeing programs.
  • Families: parents, mothers, and guardians participating as Referents in the process of their children or dependents, through specific follow-up portals.
  • Professional Facilitators: vocational counselors, psychologists, coaches, and mentors using the platform as a support tool in their professional practice.

2.3 Advisory Nature of the Service

IMPORTANT NOTICE: The Service is exclusively advisory and informational in nature.

The Reports, recommendations, career suggestions, and professional trajectories generated by the platform result from algorithmic processing of the User's own responses to the Assessments, and do not in any case constitute:

  • Medical, psychological, or psychiatric diagnoses.
  • Binding professional advice on educational, labor, financial, or legal matters.
  • Clinical assessments of skills, cognitive abilities, or mental health conditions.
  • Automated decisions with legal effects on the User under Article 22 of the GDPR.
  • Guarantees of academic, professional, economic, or personal success.

360° PathFinder expressly recommends that the results of the Assessments and Reports be interpreted and supplemented by a qualified professional (vocational counselor, psychologist, career coach, or certified facilitator) who can contextualize the findings according to the User's personal, academic, family, and socioeconomic circumstances.

3. Eligibility and User Accounts

3.1 Minimum Age

To create an Account and use the Service, the User must be at least 14 years of age. In all cases, use by persons under 18 requires authorization from a parent, guardian, or educational Institution. For users under 13 in the United States, verifiable parental consent is required in accordance with COPPA (Children's Online Privacy Protection Act).

3.2 Account Responsibility

The User is responsible for maintaining the confidentiality of their access credentials and all activities carried out under their Account. In case of unauthorized use, they must notify us immediately at legal@3lox.com. When the User is a minor, their parents or guardians share responsibility for supervising use of the platform.

3.3 Accuracy of Information

The User warrants that all information provided when creating their Account and when responding to the Assessments is truthful, complete, and up to date. 3LOX reserves the right to suspend or cancel Accounts containing false or fraudulent information.

4. Plans, Pricing and Contracting

4.1 Available Plans

3LOX offers various subscription plans with different levels of functionality and access. Current plans, their features, prices, and specific conditions are detailed and kept up to date on the official Service page: https://360pathfinder.com/precios.

3LOX reserves the right to modify, add, or discontinue plans at any time. Changes to plans will not affect active subscriptions until the end of their contracted period, unless otherwise agreed between the parties.

4.2 Institutional Contracting

Institutions may contract the Service through corporate or educational licenses. Pricing details, volumes, discounts, and specific conditions shall be governed by the purchase order, commercial proposal, or contract individually signed between the Institution and 3LOX LLC.

4.3 Pilots and Free Plans

3LOX may offer, at its sole discretion, pilot tests, limited access, or free plans with restricted functionality. These offers may be modified or withdrawn without notice and do not create any contractual obligation of permanence.

5. Payments, Billing and Cancellation

Payments are processed securely through PCI DSS-certified payment platforms, such as Stripe or equivalent services.

Published prices will include or exclude taxes as indicated in each case and in accordance with the tax legislation applicable in the User's jurisdiction.

Fees are non-refundable once the service period has commenced, except as provided by applicable consumer protection legislation (including the 14-day withdrawal right for European Union consumers under Directive 2011/83/EU, where applicable and the service has not been fully performed).

Cancellation prevents future charges but does not entitle the User to retroactive refunds for periods already commenced.

In the event of payment default, 3LOX may suspend access to the Service following notification to the User or Institution.

5.1 Satisfaction Guarantee — 30 Days

3LOX LLC offers a 30-calendar-day Satisfaction Guarantee from the date of purchase, applicable to B2C subscription plans (Discovery, Clarity, and Elite) purchased directly by the User through the 360° PathFinder website.

To claim this guarantee, the User must:

  • Have completed all 14 Self-Discovery Missions available on the platform.
  • Submit their refund request within 30 calendar days of the purchase date.
  • Send their request to support@360pathfinder.com indicating the purchase email address and the reason for the request.

Once these conditions are met, 3LOX will process a full refund of the amount paid within a maximum of 10 business days, via the same payment method used at the time of purchase.

Exclusions. This guarantee does not apply to: (a) institutional or corporate plans, which are governed by the specific contract signed with the Institution; (b) the Upgrade OTO (difference between plans), where the base plan is not eligible for refund; (c) requests submitted more than 30 days after the purchase date; (d) accounts suspended for breach of the Terms of Use.

This guarantee is independent of and complementary to the withdrawal rights recognized by applicable consumer protection legislation (including the 14-day withdrawal right for EU consumers under Directive 2011/83/EU), which are maintained in all cases.

6. Acceptable Use

The User agrees to use the Service in a lawful, ethical manner consistent with its purpose. In particular, the User agrees not to:

  • Circumvent, disable, or interfere with the security features of the Service.
  • Reverse engineer, decompile, disassemble, or attempt to extract the source code, algorithms, or architecture of the Service.
  • Access the Service through bots, scrapers, automated scripts, or other unauthorized means.
  • Upload, transmit, or distribute unlawful, defamatory, obscene, threatening, or harmful content.
  • Impersonate another person or entity, or provide false information.
  • Use the Service to harass, discriminate against, intimidate, or harm third parties.

  • Use the results or Reports for purposes other than vocational guidance and personal development.
  • Use the results as the sole criterion for academic, employment, admissions, or personnel selection decisions without the involvement of a qualified professional.

7. Intellectual Property

7.1 3LOX Rights

3LOX LLC and its licensors retain all intellectual and industrial property rights over the Service, including without limitation: software, source code, interfaces, graphic designs, registered trademarks (including "360° PathFinder", "360PathFinder" and their logos), trade names, algorithms, data models, methodologies, proprietary theoretical frameworks, Reports, editorial content, and any related materials.

7.2 License to User

Reports generated by the Service are the intellectual property of 3LOX LLC. The User receives a personal, limited, non-exclusive, non-transferable, and revocable license to access and use such Reports solely for vocational guidance and personal development purposes. This license does not authorize the User to reproduce, modify, distribute, sublicense, sell, or commercially exploit the Reports, in whole or in part, without prior written authorization from 3LOX.

8. User Content and Limited License

The User retains all ownership rights over their Content (assessment responses, personal data, uploaded files). By using the Service, the User grants 3LOX LLC a non-exclusive, worldwide, royalty-free license, limited in time (for the duration of the Account), to host, process, analyze, and display such Content for the sole purpose of operating, providing, and improving the Service. 3LOX may use anonymized and aggregated data (which does not allow direct or indirect identification of the User) for research, statistical analysis, and Service improvement purposes, without time limit.

9. Personal Data Processing and Privacy

The processing of personal data is governed by the 360° PathFinder Privacy Policy, available at https://360pathfinder.com/politica-privacidad, which forms an integral part of these Terms. 3LOX LLC complies with applicable data protection regulations including GDPR (EU), CCPA/CPRA (California), COPPA (US), Ley 1581 de 2012 (Colombia), LGPD (Brazil), and other applicable national laws.

10. Artificial Intelligence and Proprietary Algorithms

10.1 Proprietary Technology

360° PathFinder uses artificial intelligence algorithms and data processing models designed, developed, and maintained entirely by the 3LOX LLC technical team as the company's exclusive intellectual property. These algorithms include, without limitation: the IKIGAI synthesis algorithm, the Value Creation Roles (VCR) model, the Possible Career Trajectory Map (MTP) engine, the personalized AI assistant (K-AI), and Action Plan and career recommendation algorithms.

10.2 Advisory Nature of Results

Results generated by 360° PathFinder's algorithms and AI are exclusively advisory and informational. The User acknowledges that Reports do not constitute automated decisions with legal effects under Article 22 of the GDPR, and that no result constitutes a professional, medical, or psychological diagnosis, nor a guarantee of employability or academic success. The User retains full and exclusive responsibility for their academic, professional, and life decisions.

10.3 AI Disclosure (Article 50 AI Act)

In compliance with Article 50 of Regulation (EU) 2024/1689 (AI Act), 3LOX informs the User that K-AI ("Kai") is an artificial intelligence system. All User interactions with Kai are identified as such through clear and visible notices within the platform. Reports and narrative content generated by the Service are produced by artificial intelligence in an automated manner based on User responses to the Assessments.

11. Protection of Minors

When the Service is used by minors, the following protective measures apply: marketing and advertising tracking cookies will be automatically disabled; only data strictly necessary for educational service provision will be collected; minor's data will be retained for a maximum of 24 months from last activity; parents, guardians, or institutional representatives may request access, rectification, or deletion of minor's data at any time by writing to legal@3lox.com. The Service will not include personalized advertising directed at minors.

12. Regulatory Compliance

12.1 FERPA (United States)

When the Service is used by educational institutions in the United States, 3LOX LLC will act as a "School Official" with a "legitimate educational interest" under FERPA, using data solely for educational and vocational guidance purposes.

12.2 European Educational Regulations

In the European Union, data processing in the educational context is carried out in accordance with the GDPR and applicable national legislation. In Spain, processing is legitimized by the educational and guidance function under the Organic Law on Education (LOE/LOMLOE).

12.3 Colombian and Latin American Regulations

In Colombia, educational data processing is governed by Law 1581 of 2012 and the regulations of the Ministry of National Education. In other Latin American countries, applicable local data protection laws apply.

13. Service Limitations and Disclaimer

13.1 Nature of the Service

The User expressly acknowledges that 360° PathFinder Assessments and Reports are solely for educational and advisory purposes; they do not replace medical, psychological, or psychiatric diagnoses; results are a statistical approximation based on User responses and recognized scientific models, but are neither infallible nor exhaustive; and 3LOX does not guarantee any academic, employment, economic, admission, or personal outcomes derived from use of the Service.

13.2 Disclaimer of Liability

To the maximum extent permitted by applicable law, 3LOX LLC shall not be liable for: any academic, professional, financial, or personal decision made by the User based on Reports or Service results; direct, indirect, incidental, special, consequential, punitive, or exemplary damages arising from use or inability to use the Service; inaccuracies, errors, or omissions in generated Reports; losses arising from interruptions, technical failures, cyberattacks, or events outside its reasonable control; or the content, practices, or privacy policies of third-party websites or services linked from the Service.

13.3 Limitation of Liability

Without prejudice to the foregoing, the total cumulative liability of 3LOX LLC to the User or Institution for any claim arising from use of the Service shall not exceed, in any case, the greater of: (a) the amount actually paid by the User or Institution to 3LOX in the 12 months immediately prior to the event giving rise to the claim, or (b) one hundred US dollars (USD 100.00).

14. Third-Party Services and Integrations

The Service may include integrations with third-party services including payment platforms (Stripe), analytics tools (Google Analytics), marketing tools (Meta Pixel, Google Ads), cloud infrastructure (Amazon Web Services), and third-party AI services. 3LOX does not control, endorse, or assume responsibility for the content, operation, or privacy policies of these providers.

15. Modifications to the Service

3LOX LLC may update, modify, add, or suspend Service features at any time to improve User experience, comply with legal requirements, or for technical or operational reasons. For material modifications affecting an Institution during a valid contract, 3LOX will provide at least 30 days' prior notice, unless the modification is required by law or security reasons.

16. Indemnification

The User agrees to indemnify, defend, and hold harmless 3LOX LLC, its officers, employees, agents, affiliates, and licensors against any claim, demand, damage, loss, cost, or expense (including reasonable attorney's fees) arising from: misuse of the Service; violation of these Terms or any applicable law; infringement of third-party rights; or User Content uploaded or transmitted through the Service.

17. Force Majeure

3LOX LLC shall not be liable for delays, interruptions, or failures in Service provision due to causes outside its reasonable control, including natural disasters, pandemics, acts of terrorism, cyberattacks, third-party infrastructure failures, Internet interruptions, governmental actions, strikes, or any other force majeure event.

18. Suspension or Termination

3LOX LLC may temporarily suspend or permanently cancel a User's access if the User breaches these Terms or any supplementary policy, or if fraudulent, abusive, or security-threatening activity is detected. 3LOX will provide prior notice of suspension or termination except where immediate action is required for security reasons or to prevent ongoing damage.

19. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States. For consumer users in the European Union, mandatory consumer protection laws of the User's country of residence shall apply in addition to Florida law. For institutional or commercial disputes, the parties agree to submit to the exclusive jurisdiction of the courts of Miami-Dade County, Florida.

20. Modifications to these Terms
